Warranty and Disclaimer:

LWG Data Recovery warrants that it will perform any evaluation and recovery services in a timely and workmanlike manner.  Except as expressly set forth in the preceding sentence, LWG Data Recovery does not make any representation or warranty with respect to the services to be provided under this work order or the amount of data that may be recovered from the equipment.  LWG DATA RECOVERY HEREBY DISCLAIMS ANY AND ALL OTHER REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR THE ACCURACY, SEQUENCE, OR COMPLETENESS OF ANY RECOVERED DATA.

Non-Disclosure:

LWG Data Recovery agrees to keep all data recovered from the equipment confidential, and will apply the same standards of care in maintaining the confidentiality and security of the Client's data as it does in maintaining the confidentiality and security of its own confidential data. Any data recovered from the equipment will be provided solely to the Client.  Any information requested from the Client will be solely for the purpose of recovering the desired data.  LWG Data Recovery will, however, disclose any recovered data to governmental authorities or other parties if required to do so by court order or law.  Any such disclosure will be deemed not to violate the provisions of this work order.  

Exclusion of Liability from Claims:

The Client acknowledges that the equipment and/or data stored on the equipment is now damaged, and that the recovery efforts of LWG Data Recovery may result in further damage to and/or the destruction of the equipment and/or the data.  The Client expressly releases and forever waives any claims that it may have against LWG Data Recovery from any damage to or destruction of the equipment and/or the data during the data recovery effort.  LWG Data Recovery shall have no liability for any claim of the Client or any third party (whether against the Client and/or LWG Data Recovery) based upon a claim that the equipment or any data was damaged, altered, or rendered unusable. 

Title to Equipment and Data / Risk of Loss:

The Client warrants and represents to LWG Data Recovery that it is the owner of, and/or has the right to be in possession of, all data, technology and equipment furnished to LWG Data Recovery under this work order.  While the equipment is in transit or in possession of LWG Data Recovery, the Client will bear all risk of loss with respect to the equipment and the data stored thereon  from fire, flood, earthquake, tornado, acts of war or terrorism, or other act of God. The Client will bear all transportation and storage charges with respect to the equipment.

Indemnification:

The Client will defend at its expense, indemnify and hold LWG Data Recovery harmless against any damages, costs and expenses (including reasonable attorneys fees) that may arise from any third party claims against LWG Data Recovery or the Client with respect to the equipment or data.

Limitation of Damages / Terms of Agreement:

This work order supersedes all prior agreements, written or oral, between LWG Data Recovery and the Client. The parties agree, notwithstanding any other provision of this work order, that LWG Data Recovery's liability to the Client shall in no event exceed the amount paid by the customer to LWG Data Recovery under this work order.  This work order shall be construed and interpreted in accordance with the laws in the state of Illinois, and will remain in full force and effect unless otherwise agreed to, in writing, by both parties.
